General Terms & Conditions for Rental Equipment & Show Room Accessories
1.General Conditions: Any order implies the client a full and complete adhesion to these conditions of rentals
2.Equipment: Rent Mannequins, Torsos, Busts, Hangers & Accessories Presentation All information on products are only given for indicative purposes (advisory purpose) and shall not entail the responsibility of the owner
3.Geographic Area / Length of Rental Rental offers are only valid in France, Corsica and Monaco. The rental is granted for a period from 1 to 7 days.
4.Purchase Order: All purchase orders must be in writing (Order Form). The order form must be correctly and clearly filled to facilitate the invoice edit as well as and the delivery and return of equipment.
5.Pricing Rental price excludes taxes and shipping costs. The charges for delivery and return are at the customer's expense and are calculated on the weight, volume and location of delivery of equipment specified on the purchase order. Unless prior agreement between the owner and the customer, the rental prices are those of the tariff in force at the date of the order.
6.Security Deposit For rental, the customer shall attach to the invoice a separate check uncashed to guarantee a bond set 3 times the amount of the rent. The security deposit refund will be made within 2 business days after the delivery of the equipment returned in good condition.
7.Billing: A pro-set forma bill established from the order form and elements of pricing will be sent to the client.
8.Confirmation Order: To be taken into account, the purchase order must be returned signed and dated with the pro-forma invoice together with its rules and security deposit as attachment. Any billing dispute must be made by a registered letter within the next 10 days following the delivery of equipment
9.Cancellation Order: Any cancellation must be sent to LA BONNE ACCROCHE by registered letter at least 8 days before the date of the delivery.
10.Lead times for Delivery: Our delivery times are only given approximatively. We cannot be held responsible for delays by the carrier in the delivery of packages.
11.Delivery of equipment rented Whatever arrangements for the transport and / or installation, the customer is responsible for the equipment as soon as it leaves the owner's. The customer is responsible up to the recovery or restitution in our premises. The customer acknowledges the compliance and the absence of apparent defects delivered packages. At delivery, it is the customer or his representative who are in charge of recognizing the state of the packages prior to their opening. In case of apparent defects packages,the client must formulate reservations to the carrier and notify them accurately on the delivery note before taking possession. The absence of reserve applies compliance. In case of non compliant shipping or subject to dispute, claims must be sent by registered letter with acknowledgment of receipt within 24 hours of receipt of the equipment and before any use of material. Not having submitted valid claims on the status of the rented equipment and quantities, the customer will be deemed to have been taken it in good general condition, with the obligation to make such end rental. The customer who carries the equipment itself is committed to do so in the best conditions. 12.Insurance The material being not insured during the rental period, the customer is advised to ensure all risks of the rental equipment (vandalism, natural disasters, injuries and damage ...) with his insurance company. All possible taxes, charges, fees, licenses, insurance, etc. .. shall be borne by the customer. The customer is supposed to know how to use and handle the equipment, therefore it will be liable for any misuse. The customer hereby certifies to know all the warnings of security risks and precautions relating to the use of rented equipment. In the event of loss, damage or non compliance with the terms and conditions of rental, the customer agrees to pay LA BONNE ACCROCHE the correct amount of the bill replacing lost or damaged equipment.
13.Return of rental equipment Back orders cannot be changed without the agreement of our Company. Rented equipment must be returned in its original packaging. When returning the equipment, any defect, irregularity or excessive wear by compared to the use specified, are reported to the customer's expense. The undergoing equipment repairs will be charged by the customer. If the material can not be repaired, or is not returned within 8 clear days, it will be considered as missing . The missing equipment will be charged to return through the bond filled by the customer.
14.Subject to Property: Rental equipment is owned full of LA BONNE ACCROCHE and is elusive. This agreement is binding not only the buyer but also to its creditors and third parties.
15.Assigning Skills : Litigation Any dispute or litigation, the Court upon which depends the head office of the provider will be solely responsible
